I received a request for more information and an explanation of what is happening to my claim today. When it filled their needs the VA did not hesitate to simply reinterpret AO '91 by altering M21 without public notification. Now when it fits their needs they use the opposite tactic to delay my claim. In spite of the IOM and multiple other reports showing the relationship between Diabetes and Coronary Artery disease, and the Secretary's own admission of the connection I was told they have certain legal steps they must follow before it can be added as presumptive and this includes presenting it in the Federal Register which "could take a year or more. In the mean time we will hold your claim and notify you of any changes". This time , to follow the law fits their agenda better than to not follow it. ...... did you ever notice there is never a real signature on these letters, I guess that's because of the phone directory and stalking, I never qualified as a sharp shooter but I have bagged a buck or two in my time.

Frank, if there are some other claims you have submitted that are not related to AO, I would suggest that you file another NOD on those items or your time limit will run out. They don't have to tell you that you have a time limit on other claims and if you don't request a BVA or a DRO hearing, then you will be too late. I think that NVLSP could find grounds for a law suit if your claim was held up for Haas and the time limit ran out, while waiting for VA to make a desicion on AO related claims.
