BOARD OF VETERANS' APPEALS Update 01: Secretary of Veterans Affairs Eric K. Shinseki announced the addition of four new Veterans Law Judges to the Board of Veterans' Appeals (BVA), which will enable the board to increase the number of cases being decided. “Veterans have earned the right to prompt, exhaustive and professional review of their claims for benefits,” Secretary Shinseki said. “This expansion of BVA will enable Veterans to receive more expeditious decisions on their appeals.” BVA is an appeals body to which Veterans, their dependents or their survivors can go when they are not satisfied with decisions about claims for benefits administered by the Department of Veterans Affairs (VA). BVA reviews decisions on benefit claims made by local VA offices and issues decisions on appeals. The board currently has 60 Veterans Law Judges. These law judges are attorneys experienced in Veterans law and in reviewing benefit claims. They are the only ones who can issue BVA decisions. Staff attorneys, also trained in Veterans law, review the facts of each appeal and assist the board members.

In fiscal year 2008, the board decided 43,757 appeals and handled 48,804 cases in fiscal year 2009. Most of the cases involve claims for disability compensation and pensions. “We must foster a responsive approach when we consider Veterans,” Shinseki said. “Reducing the backlog of benefits decisions and waiting times are essential to providing our Veterans and their families with the service they deserve.” VA provides a pamphlet entitled, How Do I Appeal, to anyone who is not satisfied with the results of a benefits claim that was decided by a VA regional office, medical center or another local VA office. So that's how they do it! There not going to decide more cases, just handle?

This is wrong for all the right reasons. If they put such an attorney at each regional office to help review claims that come out of rating, they could keep the cost down for claims disagreements (maybe) or at least limit the mistakes. This would hopefully same mountains of time if the claim had a "judge"-type mind at the R/O (but NOT a Judge per se) that would limit the NODs and spare the time of getting on the Boards docket to begin with, which in turn would result in less claim bouncing, which would lower the backlog build-up.

JR, I have a hearing with mine in Dec., sure was surprizing how fast they got me on the docket, I think it was about 2 weeks after filing the NOD in the first part of October when I recieved the notification.

Ken,

That is not suprizing fast, but super-sonic fast. Do you mind if I ask you, what option did you take, tele-conference, appeal with a Veteran's Law judge at the RO, or a face to face with a Veteran's Law Judge in Washington. I,m on my second appeal, the first took almost two years, the second was back in Dec 08. The first was in Wash, I also opted for Washington for the second.

This will be in person with this judge at local RO in Reno. My VSO told me that she just came on board in recent time,( not specific of the time frame), but he has seen better results since the judge has come onboard with the personal touch and conversations rather than having to finger through so much paper work. He believes points of interest, facts and evidence get pointed out by the vet that may get missed with the adjudicator.

This is going to be a DRO hearing. The letter was dated Oct 26, and I had filed the NOD about 2 weeks earlier after the denial arrived in the mail for the rating decission just a week before that or so after 3 years waiting due to the Haas Stay. What surprized me was that my VSO said it would probably be six months before I would get that hearing, then I said hopefully 2254 would be law by then I wouldn't have to worry abought it. Boy has this one bit me in the posterior now knowing that I will probably have the hearing before AO of 09 makes it through or not, and knowing their stand with rules and so on right now, this very well could be a waste of time, just a formality on their part to say they have followed the book.

But then, one never knows anymore with what has been happening the past few days.
