March 6 Motion Filed
On Tuesday, March 6, the NVLSP filed a motion opposing the government's
motion for an extension of time
within which to file their brief.
We are aware of no other actions by the Courts or the government in either Haas or Ribaudo this week.
March 3 - VA Asks for another extension
On Friday March 2, very late afternoon, the Government asked the Court
for another extension of time, until Wednesday March 7,
within which to
file their Brief. Apparently, the Solicitor General has still not given
the VA final approval for the appeal.
The Court has not yet acted on
the motion.

As of midday, Friday, March 2...
.... delivery of the VA brief has not yet been received. However, to legally meet their deadline, the brief simply must be postmarked sometime before midnight. So, if that is the proceedure they followed, receipt by the Court and the defendants will not occur until next week.
VA Granted Another Extention In Filing Their Brief
On February 20, 2007, the Department of Justice (DOJ) filed a motion for
an enlargement of time of nine days within which to file their brief.
The primary reason cited was for the DOJ to confer with the Office of
the Solicitor General and obtain final authorization for the appeal.
The Court granted the motion. Now the Government's brief is due on
March 2, 2007.
